This petition calls on the Australian Government and State Legislatures to formally introduce and pass the Clothing-Optional Recreational Areas Bill, which establishes a legal and respectful framework for the designation and management of clothing-optional zones in national parks, beaches, walking trails, and other public spaces.

Naturism and clothing-optional recreation are peaceful, non-sexual expressions of body freedom, environmental harmony, and personal well-being. Around the world, many countries have long embraced such practices with great social, health, and tourism benefits. Australia should not lag behind.

By providing legal clarity, protecting public decency standards, and outlining clear boundaries and conduct expectations, this Bill ensures both naturists and non-naturists can enjoy shared spaces in mutual respect and safety.

What the Bill Will Achieve:

  • Legally designate clothing-optional zones such as beaches, parks, and trails, with clear signage and boundaries.

  • Allow event-based permits for clothing-optional festivals, retreats, or gatherings.

  • Ensure strict behavioural codes, banning sexual activity, harassment, or unwanted photography.

  • Protect individuals from arrest or fines when lawfully using designated zones.

  • Promote mental health, body acceptance, and tourism through safe naturist recreation.

  • Require regular community consultation, environmental review, and adjustments to reflect public feedback.

TEIL 1 - VORLÄUFIG

1. Short Title
This Act may be cited as the Clothing-Optional Recreational Areas Bill.

2. Commencement
This Act shall commence on a date to be proclaimed, following the successful passage of legislation clarifying public decency and lawful nudity.

3. Purpose
The purpose of this Bill is to:
(a) Provide legal recognition and designation of public recreational spaces where clothing-optional use is permitted;
(b) Promote inclusiveness, body acceptance, and personal freedoms;
(c) Support tourism, mental health, and community wellbeing through designated clothing-optional zones;
(d) Ensure that such areas are managed responsibly, with respect for the environment, cultural heritage, and the rights of all users.

4. Definitionen

  • Clothing-optional means a legally designated area where individuals may choose to be nude or clothed without fear of legal repercussions.

  • Naturist activity means the peaceful, non-sexual practice of social or individual nudity in accordance with personal, philosophical, environmental, or cultural beliefs.

  • Designated area means a specific beach, park, trail, or recreational space formally declared by local or state government for clothing-optional use.

  • Respectful conduct means behaviour that does not include sexual activity, harassment, or offensive actions toward others.

PART 2 – DESIGNATION OF CLOTHING-OPTIONAL AREAS

5. Declaration of Clothing-Optional Zones
(1) Local councils or state governments may, by public notice and consultation, declare specific public recreational areas as clothing-optional.
(2) Declarations must include clear signage, boundaries, and public awareness efforts to inform all users of the clothing-optional status.

6. Criteria for Designation
In determining suitability for clothing-optional designation, the following shall be considered:
(a) Environmental sustainability and conservation impact;
(b) Accessibility and proximity to residential areas;
(c) Existing cultural, Indigenous, or heritage considerations;
(d) Public support or objection following community consultation;
(e) Availability of basic amenities (e.g. waste disposal, toilets, signage).

7. Temporary or Event-Based Designations
(1) Councils may approve temporary clothing-optional status for events, festivals, or wellness retreats upon application.
(2) Such events must include risk assessments, insurance coverage, and be conducted with respect and community safety in mind.

PART 3 – CONDUCT AND MANAGEMENT

8. Code of Conduct in Clothing-Optional Areas
All users of designated clothing-optional zones must adhere to the following:
(a) No sexual conduct or suggestive behaviour;
(b) No photography or filming of others without their express consent;
(c) Respect for personal space, diversity, and family-friendly use;
(d) Compliance with environmental protection rules and fire bans;
(e) No lewdness, indecency, or harassment.

9. Signage and Community Education
(1) Clearly marked signs must be installed at entry points to clothing-optional areas.
(2) Educational campaigns will be supported to promote respectful behaviour, body acceptance, and the lawful boundaries of naturist activities.

10. Role of Authorities
(1) Rangers, council officers, or designated law enforcement may monitor these areas to ensure compliance.
(2) Penalties may apply for breaches of conduct or for offensive behaviour unrelated to simple nudity.

PART 4 – LEGAL PROTECTIONS AND SUPPORT

11. Legal Protection for Lawful Use
(1) Individuals within designated clothing-optional areas who are nude or semi-nude shall not be subject to arrest, fines, or public indecency charges, provided their conduct remains lawful and respectful.
(2) This provision shall not apply where such conduct occurs outside declared zones.

12. Protection Against Harassment and Abuse
(1) It shall be an offence to harass, photograph without consent, or abuse any person in a clothing-optional area.
(2) Offenders may face penalties under relevant harassment or privacy laws.

13. Tourism, Health, and Community Benefits
State and local governments are encouraged to:
(a) Promote clothing-optional areas as part of nature-based tourism strategies;
(b) Recognise the mental health and body acceptance benefits of lawful naturist activities;
(c) Facilitate partnerships with naturist organisations for site management and education.

PART 5 – REVIEW AND ADJUSTMENTS

14. Community Consultation and Feedback Mechanism
Each council must establish a clear and accessible method for public feedback, dispute resolution, and suggestion regarding clothing-optional zones.

15. Review of Designated Areas
Designated areas shall be reviewed every five (5) years, or earlier if significant public concern or safety issues arise.

16. Amendments and Expansion
Additional areas may be nominated by naturist associations, tourism bodies, or community groups. Nominations must be supported by environmental and social impact assessments.
