Laws affecting nudity are not always written specifically with nudism or naturism in mind. Terminology, definitions and legal boundaries can therefore matter considerably.

This resource can help you ask the appropriate legal authority for clarification, review or consideration of issues affecting legitimate nudism, naturism and non-sexual nudity.

The objective is not to assume what the law says. It is to ask clearly what the law means, identify possible gaps or ambiguity, and invite appropriate consideration where necessary.

You do not need to belong to NaturismRE, a federation, club or other organisation to use this resource.

You do not represent NRE by using the template. Your correspondence should be sent in your own name and adapted to your own jurisdiction and circumstances.

What Can You Ask an Attorney General or Justice Minister?

The appropriate question will depend upon the law and government structure in your jurisdiction. You may wish to raise one specific issue rather than attempting to address everything at once.

Non-Sexual Nudity

Ask how existing legislation distinguishes simple non-sexual nudity from sexual conduct, indecency or other prohibited behaviour.

Legal Terminology

Ask whether terminology or definitions within existing law may create ambiguity or inconsistent interpretation.

Nudism & Naturism

Ask whether legitimate nudism and naturism are recognised or adequately distinguished from sexualised activity.

Legal Certainty

Ask whether members of the public, enforcement authorities and institutions have sufficiently clear guidance concerning lawful and unlawful conduct.

Discrimination & Treatment

Ask whether existing frameworks adequately address adverse treatment associated with otherwise lawful nudist or naturist participation.

Potential Reform

Where gaps are identified, ask whether clarification, guidance, review or legislative reform may be appropriate.

Before You Write

Do not assume that an Attorney General or Justice Minister has responsibility for every law involving nudity.

In Australia, for example, criminal law, local-government rules, land management, discrimination law and online regulation may involve different levels of government and different authorities.

Identify the specific issue and jurisdiction first. Where possible, identify the legislation, policy, decision or legal uncertainty that concerns you.

Ask for clarification before asserting that conduct is legal, illegal, protected or prohibited. This makes correspondence more precise and reduces the risk of relying on an incorrect legal assumption.

  • how non-sexual nudity is treated under existing legislation;
  • whether nudism and naturism are expressly recognised or otherwise distinguished from sexual conduct;
  • whether terminology used in legislation creates ambiguity or the potential for inconsistent interpretation;
  • whether otherwise lawful naturist participation can be adversely affected by unclear or outdated legal frameworks;
  • whether existing frameworks adequately address relevant discrimination or adverse treatment where applicable;
  • whether clarification, guidance, further review or legislative reform may be appropriate where gaps are identified.

NaturismRE has developed the NICP Act, a model legislative framework intended to contribute to discussion concerning terminology, legal recognition, digital treatment, discrimination and the distinction between legitimate nudism and naturism and sexual activity.

I am not suggesting that this model necessarily represents the appropriate legislative solution for [jurisdiction]. I am asking whether your office would be willing to examine the issues it raises and consider whether existing law already addresses them adequately or whether further clarification may be warranted.

The NICP Act

The NICP Act is a model legislative framework developed by NaturismRE. It is intended to provide governments, policymakers, legal stakeholders and the wider community with a structured proposal for considering issues affecting nudism and naturism.

It addresses areas including terminology, legal recognition, digital treatment, discrimination and the distinction between legitimate nudism and naturism and sexual activity.

The framework is provided for examination, discussion and adaptation. Referring an Attorney General or Justice Minister to the NICP Act does not require them to accept the framework in its entirety.

Make the Letter Specific

Legal correspondence is more useful when the question being asked is clear.

If your concern involves a particular law, provision, government decision or enforcement issue, identify it where possible.

If you do not know the relevant legislation, you can instead ask the Attorney General's or Justice Minister's office to identify the applicable legal framework.

Avoid stating that you have a particular legal right unless you have established that the right exists in your jurisdiction.

The purpose of this template is to help obtain clarity and invite consideration, not to substitute advocacy claims for legal interpretation.

Jurisdiction Matters

Laws affecting nudity, public conduct, discrimination, digital services and public spaces differ between countries and may also differ between states, provinces, territories and municipalities.

A national Attorney General may not control a law administered by a state or local authority. Likewise, a state or provincial government may have no authority over certain national laws.

Before sending correspondence, identify the jurisdiction involved as accurately as possible.

When You Receive a Response

Read carefully what the office actually says.

A response may explain the existing law, identify another responsible authority, state that reform is not currently being considered, or indicate that the matter has been referred for further consideration.

Do not describe an acknowledgement as government support and do not treat a referral as endorsement of the proposal.

If the response raises new questions, you can follow up with a more specific request for clarification.
