Every Australian deserves the right to live authentically and express their identity without fear of discrimination, harassment, or exclusion — provided their conduct is peaceful and lawful. Whether someone chooses a minimalist lifestyle, clothing-optional living, spiritual simplicity, or a nature-based philosophy, their dignity and rights must be protected under law.

This petition calls on federal and state legislators to support the Freedom of Expression and Lifestyle Act, which affirms the personal right to lawful self-expression and protects individuals from unjust treatment based on lifestyle, personal appearance, or cultural and philosophical values — including naturism.

As social attitudes evolve, it is time Australia modernises its legal frameworks to reflect the diversity of its people and ensure fairness, respect, and non-discrimination for those who choose alternative but lawful ways of life.

What This Act Will Do:

  • Affirm the right to peaceful, lawful personal expression through clothing, nudity (where lawful), and lifestyle.

  • Protect individuals from discrimination based on body autonomy, spiritual beliefs, naturism, minimalism, or cultural expression.

  • Ensure schools, employers, landlords, and service providers cannot impose unjust penalties or conditions on lawful lifestyle choices.

  • Recognise clothing-optional living, non-sexual public nudity in designated areas, and other peaceful expressions as valid.

  • Promote public education on tolerance, freedom, and inclusion through national awareness campaigns.

  • Encourage engagement with marginalised and alternative communities in policy development and planning.

  • Establish complaint pathways and remedies for individuals who are unfairly treated.

  • Table annual reports to Parliament on rights-related trends, feedback, and progress.

PARTIE 1 - PRÉLIMINAIRE

1. Short Title
This Act may be cited as the Freedom of Expression and Lifestyle Act.

3. Purpose
The purpose of this Act is to:
(a) Affirm the right of individuals to express themselves lawfully through personal appearance, lifestyle, and non-harmful conduct;
(b) Protect individuals from discrimination, harassment, or unjust treatment based on peaceful lifestyle choices, including but not limited to naturism, minimalism, spiritual or cultural practices, or clothing-optional living;
(c) Ensure that personal freedom of expression is safeguarded in public, private, and institutional settings, subject to existing laws regarding safety, public order, and community standards.

4. Définitions
Aux fins du présent acte :

  • Freedom of expression includes physical appearance, clothing choices, symbolic acts, peaceful nudity (where lawful), and the communication of personal, cultural, philosophical, or lifestyle values.

  • Lifestyle refers to an individual’s voluntary way of living, including but not limited to dietary preferences, body presentation, spiritual practices, and clothing choices, provided they do not cause harm to others.

  • Lawful expression refers to behaviour or appearance that does not contravene public order, decency, or criminal law as defined by relevant state and federal legislation.

  • Discrimination includes any act of exclusion, restriction, or preference based on a person’s lifestyle or expressive choices.

PART 2 – RIGHTS AND PROTECTIONS

5. Recognition of Lifestyle and Personal Expression Rights
(1) All individuals have the right to express their identity, lifestyle, and beliefs in a manner that is peaceful and lawful.
(2) Public nudity or clothing-optional expression, where permitted by law, shall be considered a protected form of non-verbal expression under this Act.

6. Protection Against Discrimination
It is unlawful to discriminate against, harass, or victimise any person on the basis of:
(a) Their lawful lifestyle or appearance;
(b) Their participation in peaceful, non-sexual nudity in permitted areas;
(c) Their philosophical or personal beliefs relating to body autonomy, natural living, or alternative ways of life.

7. Institutional Obligations
(1) Employers, landlords, schools, and service providers must not impose unjust restrictions or penalties on individuals based solely on their lawful personal expression or lifestyle.
(2) Institutions may set minimum standards of dress or conduct where safety, health, or reasonable operational requirements apply, but such policies must be applied consistently and without prejudice.

PART 3 – IMPLEMENTATION AND ENFORCEMENT

8. Complaint Mechanism
(1) Any person who believes their rights under this Act have been violated may file a complaint with the relevant state or federal anti-discrimination commission or human rights body.
(2) Remedies may include:
(a) Compensation;
(b) Reinstatement or removal of penalties;
(c) Injunctions or public apologies.

9. Exemptions
(1) Nothing in this Act shall override laws relating to national security, public health, criminal conduct, or specific safety protocols.
(2) Religious institutions may maintain specific appearance or conduct standards for internal practices, provided these do not affect individuals outside the institution or breach anti-discrimination laws.

PART 4 – PUBLIC EDUCATION AND COMMUNITY AWARENESS

10. Public Awareness Campaigns
(1) The Human Rights Commission and Department of Social Services shall collaborate to develop public information materials on personal freedoms, respectful conduct, and lawful expression.
(2) These campaigns will promote tolerance, inclusivity, and understanding of diverse lifestyles and appearance choices.

11. Engagement with Marginalised and Alternative Communities
Government departments are encouraged to engage with representatives from naturist, minimalist, alternative spiritual, and other lawful lifestyle groups to inform policy development, urban planning, and community inclusion efforts.

PART 5 – REVIEW AND ADJUSTMENT

12. Annual Report
The relevant Minister shall table an annual report to Parliament on the application and effectiveness of this Act, including trends in complaints, community feedback, and any recommended legislative improvements.

13. Sunset and Review Clause
This Act shall be reviewed five (5) years after its commencement to assess its impact, effectiveness, and any need for expansion or refinement.
